Dealing with the death or disability of a loved one is an emotional challenge. Dealing with the legal aspects of your loved one’s death or disability at the same time can be overwhelming. We work with our clients to help navigate and handle the legal aspects in order to lessen the burden and stress at the time of your loss.
Probate is the legal process for transferring your loved one’s assets after their death governed by the courts. Probate is subject to the terms of your loved ones will, or if they did not have a will then subject to the law. Probate, or the court process, may not be necessary if your loved one had set up an estate plan with a properly funded trust (or other mechanism to transfer their assets outside of Probate) before their death.
Trust Administration is the legal process for administering and/or transferring your loved one’s assets in the event of their incapacity or death when they had established a properly funded trust during their lifetime. Trust administration is subject to the terms of the trust and is not subject to Probate through the courts.
Both Probate and Trust Administration can be complex and confusing to those who do not handle it on a regular basis. We draw on years of legal experience as well as our own personal experiences to help you guide you either through the Probate of a loved one’s estate, or to help you administer their trust. We also draw on our connections in the local community to address the myriad situations that arise in wrapping up a loved one’s estate.
